TERMS AND CONDITIONS
Installation Agreement
By accepting an estimate, signing a proposal, or making payment, Customer agrees to the following terms and conditions.
1. Scope of Work
Shine Squad will install Omni Permanent Lighting products and associated components as outlined in the approved estimate or proposal. Any work not specifically listed in the proposal shall be considered additional work and may result in additional charges.
2. Property Access
Customer agrees to provide reasonable access to all areas necessary to complete the installation. Delays caused by restricted access, locked gates, vehicles, landscaping, animals, or other obstructions may result in additional charges.
3. HOA and Property Restrictions
Customer is solely responsible for obtaining any required approvals, permits, or permissions from homeowners' associations (HOAs), architectural review committees, property management associations, or other governing entities prior to installation. Shine Squad is not responsible for determining compliance with HOA rules, deed restrictions, covenants, architectural guidelines, or similar requirements. Any modifications, removal, relocation, or reinstallation required due to HOA or governing entity actions shall be the responsibility of the Customer and may result in additional charges.
4. Electrical Requirements
Customer is responsible for providing a functioning 120V GFCI-protected electrical outlet within reasonable distance of the controller location unless otherwise specified in the proposal.
Any electrical work beyond the lighting installation is not included unless specifically stated in writing.
5. Equipment Access and Existing Property Conditions
Customer acknowledges that installation may require the use of ladders, lifts, vehicles, trailers, and other equipment on driveways, sidewalks, landscaping, and other areas of the property. Shine Squad will take reasonable precautions to avoid damage; however, Shine Squad shall not be responsible for damage resulting from pre-existing defects, hidden conditions, weakened or improperly constructed concrete, asphalt, pavers, retaining walls, landscaping, irrigation systems, underground utilities, or other conditions not readily visible prior to installation.
Customer is responsible for identifying any known underground utilities, irrigation systems, septic components, or other concealed property features that may be affected by installation activities.
6. Payment Terms
A deposit of 35% may be required before materials are ordered.
The remaining balance is due upon completion of installation.
Invoices not paid within 15 days may be subject to a late fee of 1.5% per month or the maximum amount permitted by law, unless otherwise agreed upon in writing by both parties.
7. Change Orders
Any customer-requested changes after installation has begun may result in additional labor and material charges. All changes must be approved before work proceeds.
8. Warranty
Shine Squad warrants workmanship for one (1) year from the installation date.
Manufacturer warranties on Omni products remain subject to the manufacturer's terms and conditions.
Warranty coverage applies only to defects in installation or product failure under normal use.
Warranty does not cover:
Physical damage
Storm damage
Lightning strikes
Power surges
Fire
Flooding
Pest or animal damage
Unauthorized modifications
Damage caused by third-party contractors
Accidental damage by homeowner
Acts of God
9. Software & App Control
Permanent lighting systems utilize third-party software and mobile applications. Shine Squad is not responsible for software outages, application updates, internet connectivity issues, smartphone compatibility issues, or manufacturer server interruptions.
Reasonable assistance may be provided, but ongoing technical support is not included unless otherwise specified.
10. Service Calls
Service calls for issues not covered under warranty may be subject to a diagnostic fee plus labor and material costs.
11. Limitation of Liability
Shine Squad's liability shall be limited to the amount paid by Customer for the installation. Under no circumstances shall Shine Squad be liable for indirect, incidental, special, or consequential damages.
12. Ownership of Materials
All installed products and materials remain the property of Shine Squad until payment is received in full.
13. Photographs
Customer grants Shine Squad permission to photograph the installation for documentation, warranty records, marketing, social media, and advertising purposes. No personal identifying information will be shared without permission.
14. Cancellation
Orders canceled after materials have been ordered may be subject to restocking fees and reimbursement for any non-refundable materials, labor, or travel expenses already incurred.
15. Acceptance
Payment, signature, or acceptance of the proposal constitutes agreement to these terms and conditions.
